Advertising Rates and Pricing Schedules, Advertising Contracts, Copy Policies and Conditions

  1. Advertising Copy & Content Acceptance: All advertising is subject to review and acceptance by the Publisher of The Palm Beach Post. This includes advertising content matter, copy, graphics and illustrations, form, size and typography. We reserve the right to reject or request revision on all advertising on-paper, pre-printed inserts, or on-line deemed to be in violation of policies. We have the right to cancel any scheduled advertisement if a violation of our copy policies is discovered after original acknowledgement and acceptance for publication.
  2. Any advertising copy which may appear to resemble the type and style similar to that of The Palm Beach Post must be clearly labeled as "Advertisement," and will be accepted at the discretion of the Publisher. The Post’s actual type font may not be used in advertising material.

  3. Advertising Orders: Publisher is not responsible for orders, cancellations or corrections given over the telephone. Written confirmation of orders must be received in time to meet deadlines.
  4. Advertising Rates: Publisher has the right to determine the appropriate category of business and appropriate Pricing Schedule, for any and all advertising. Incorrect rates on insertion orders will be regarded as errors, and advertisements will be published and charged at the appropriate rates in effect at the time of publication.
  5. Retail rates apply to advertising for businesses located within the primary market area for The Palm Beach Post. Local Classified rates apply to advertising for businesses physically located within the State of Florida. Rates listed in the applicable Retail and Classified Pricing Schedules apply only to individual advertisers who sell directly to the public.

    National rates apply to advertising placed on behalf of a manufacturer, wholesaler, distributor or service provider regardless of location. This includes, but is not limited to: Travel and Transportation providers, Tourism and Destination advertising, Financial products and services, Telecommunications providers, Utilities, Gas and Oil products, Movie Studios, Media advertising, Packaged Goods, Pharmaceuticals, Insurance and other service businesses, Internet service providers, transitory events and seminars and Mail Order advertising. National Classified rates apply to advertising from businesses without a physical location within the State of Florida and/or certain lines of business.

    Co-op advertising rates apply to recognized dealer, distributor, manufacturer or other groups and associations. Advertising must be for two or more dealers in a single ad or series of ads. Dealers may be listed individually in a series of ads in a schedule. A written co-operative advertising agreement and/or stipulation form certifying that the advertisements are being paid for in part or in full from existing co-op funds accrued by participating retailers must be signed by the client and provided to The Palm Beach Post prior to publication.

  6. Advertising Rate Changes: Publisher reserves the right to revise advertising rates at any time by giving advertisers 30 days written notice.
  7. Advertising Contracts:
    • Contracts must be in writing, signed and authorized by a representative of the advertiser and the Publisher in order for the advertiser to receive appropriate and earned discounts.
    • Advertising Contracts are based on Annual Revenue Commitments (beginning at $5000 annually for Retail, $10,000 for Classified), and include all products and services of The Palm Beach Post --including full-run and zoned run-of-paper (ROP) advertising, Classified Advertising, pre-printed inserts, special sections, supplemental products, and online advertising.
    • Advertising published without an Advertising Contract will be billed at the Base Rate on the appropriate Pricing Schedule.
    • For contracts expiring in 2007: In the event that advertiser either exceeds or falls short of their contracted annual revenue commitment, applicable segments of the products utilized will be re-rated at the appropriate earned level. ( Products purchased "a la carte" will not be subject to rebate or short-rate.)
    • For contracts expiring in 2008: In the event that advertiser falls short of their contracted annual revenue commitment, applicable segments of the products utilized will be re-rated at the appropriate earned level. ( Products purchased "a la carte" will not be subject to rebate or short-rate.)
    • Advertising contracts must be signed by the advertiser (not an agent for the advertiser) unless otherwise noted on the applicable pricing schedule, and may include any and all wholly owned subsidiaries identified in advance at the inception of the contract to be accepted at the discretion of the Publisher.

  8. Terms of Payment: All advertising insertion orders and rates are cash-with-copy, unless prior credit has been established. Credit and Debit cards may be accepted for pre-payment of advertising, with restrictions. Where credit has been established, invoices are payable on the terms stipulated. Advertisers with approved credit will be invoiced monthly.
  9. Claims for credits for errors must be made within 30 days of date of invoice. Otherwise, such claims will not be considered. Accounts more than 37 days past due shall bear interest at a rate of 1.5% per month (18% per year).

    Agency Commissions: All National ROP, Classified and Local Employment Classified advertising rates are stated as gross rates. A 15% commission will be given to recognized advertising agencies. Local ROP advertising is not commissionable.

  10. Error Liability: If you require a proof prior to publication, adjustment for errors can be made only if we received your corrected copy prior to proof deadline. If no proof is requested, the first insertion will serve as a "proof," and adjustments will be made for that first insertion only. In the event of an error, notify your Palm Beach Post Advertising Account Executive immediately, so that corrections may be made for subsequent insertions. If an error appears in your advertisement, the Publisher assumes no financial liability beyond the cost of the ad insertion. Where appropriate, a partial credit or full "make-good" may serve as correction for the error. Publisher accepts no liability for finished advertising material furnished by advertiser, their agent or another publisher.
  11. General Liability: The advertiser and/or agent, by submitting their advertising for publication, represents that all facts stated in the advertisement are true and correct and that there will be no libel, invasion of the rights of privacy or publicity, or infringement of any trademark, copyright of other intellectual property right with respect to any person, partnership, corporation or other entity. Furthermore, the advertiser and advertising agency assume all liability for all content (including text representation and illustrations) of advertisements printed and preprinted material distributed, and also will assume all responsibility for any claims made against The Palm Beach Post as a result of printing this advertising.
  12. The Post will not be liable for failure to publish any advertising because of acts of God, war, fires, floods, strikes, work stoppages, breakdown of equipment or software, or any other causes beyond our reasonable control.

    The Post will not be liable for any failure to furnish advertising space or to publish any advertisement due to any cause of for any reason whatsoever.

    The sole liability and obligation of The Palm Beach Post for failure to publish any advertisement or distribute any preprinted material will be to refund any amounts paid by the advertiser or advertising agency. In addition, The Post’s liability will not exceed the cost of such advertising of distribution service at the advertiser’s earned contract rate for any error in a published ad, any late publication of an ad or late distribution of a preprint.

  13. Position requests: every effort will be made to afford advertisers the position desired; however, under no circumstances is position guaranteed, nor is advertising accepted subject to position. Advertising must be paid for regardless of position.
